Manufacturer’s Warranty
DESERT SPRING PRODUCTS warrants that its products are free from defects in parts and factory workmanship for a period of 12 months and an additional 10 years for the evaporative disc wheel (rotary disc models only). The plastic body (Flow-through and Drum models only) and plastic door (Flow-through and Drum models only) carry a lifetime warranty. For your benefit and protection, please return the Warranty Registration Card (or register on-line at www.desertspringproducts.com/registration). This will initiate the warranty period and allow us to contact you, should it be necessary. In the absence of a warranty registration, the warranty shall begin with the proof of purchase, or record of installation date. This warranty applies only in the United States of America and Canada.
The details of the warranty are as following:
(A) In the event that a part is deemed defective, the user must immediately inform DESERT SPRING PRODUCTS who will at its option furnish new or factory re-manufactured part at no cost to the user.
(B) The warranty does not cover any costs of troubleshooting, installation or maintenance. The warranty also does not apply to the following situations: any damage or defect due to mishandling; improper storage; misuse; installation, commissioning, operation and maintenance contrary to DESERT SPRING PRODUCTS’ descriptive manual or recommendation; wrong supply of electricity, water or drain; improper repair; tamper or alteration; negligence; accident; normal wear; or any cause beyond the control of DESERT SPRING PRODUCTS.
(C) The original warranty period does not change in the event of part replacement from DESERT SPRING PRODUCTS.
(D) The warranty is issued exclusively to the original consumer purchaser of record and is not transferable.
(E) The provisions of the foregoing warranty are in lieu of any other warranty, whether express or implied, written or oral (including any warranty of merchantability or fitness for a particular purpose or of title or non-infringement). DESERT SPRING PRODUCTS’ liability arising out of the manufacturer, sale, or supplying of the products or their use or disposition, whether based upon warranty, contract, tort, or otherwise, shall not exceed the actual purchase price paid by the distributor for the product(s). In no event shall DESERT SPRING PRODUCTS be liable to the distributor or any other person or entity for special, incidental, consequential or punitive damages (including, but not limited to loss of incomes, or loss of use damages) arising out of the manufacture, sale, or supplying of the products, even if DESERT SPRING PRODUCTS has been advised of the possibility of such damages or losses.
